Review and Modification:
Every three years both parties on a child support case have the right to request a case review for possible modification. However, there must be at least one year since the most recent modification.
You must follow the guidelines below for the review to be conducted. Please include your ISETS case number and the name of both parents on the case.
1. The request must be in writing along with an explanation of why you fell a review is justified. There must be a significant change in the circumstances for the case to warrant a modification that would lead to an increase in child support payments. the increase must be at least 20% before a request can be taken to court. Remember that your child support could be lowered as a result of the review.
2. You must provide the following information with your request:
A. Your three (3) most recent paycheck stubs showing your year-to-date earnings
B. Copies of your most recent Federal Income Tax Returns (summary pages only) with copies of all W-2 statements and/or 1099 forms
C. Written and signed verification of any child care expenses incurred while you are employed (for only the child(ren) listed on the case)
D. If you are currently providing insurance for the child(ren), provide written proof of the cost of said insurance. If you are not currently providing insurance but it is available from your employer, provide written proof of the cost of insurance for the child(ren) only
E. The number of overnight visits per year the non-custodial parent exercises
F. If applicable, copies of any court orders for payment of child support for any other children. Copies of birth certificates of any other biological children residing in the household of adoption papers on any non-bilogical children residing in the household.
Once the information is provided to the child support office, a request for similar data will be sent to the other party to the case who will be given ample time to provide the information. A worksheet will be completed after all information is submitted. The child support office will contact both parties upon completion of the worksheet. Allow at least 6 weeks from the time of the request before calling the office for the results.
NOTE: Failure to provide the information within the timeline could result in a subpoena being issued. If the custodial parent fails to respond to our request for information and is receiving TANF/Medicaid a request for sanctions of state benefits could be requested.
