| Information about the Pre-Trial Diversion Program (Misdemeanors) |
General Information
The Perry County Prosecutor’s Office has a Pre-Trial Deferral Program,
also known as Infraction Deferral, for safe drivers that are cited
for certain offenses. It allows motorists who have good driving records
to maintain those records. Upon completion of the infraction deferral program,
your ticket is dismissed and there are no convictions related to this ticket
on your driving record.
You are eligible for the infraction deferral program if:
- You are not an habitual traffic offender
- Your ticket was not issued in relation to an accident
- You do not have a commercial driver’s license
- You have not been on a Perry County Infraction Deferral Program within the past five years
- You have not already paid your ticket
Infraction Deferral Fees are as follows:
- Speeding 0 – 10 miles over: $182.00 – ticket is dismissed in six (6) months
- Speeding 11 – 15 miles over: $212.00 – ticket is dismissed in nine (9) months
- Speeding 16 plus: $242.00 – ticket is dismissed in twelve (12) months
- All other traffic violations: $212.00 – ticket is dismissed in nine (9) months
NOTE: You pay a fee to take advantage of this program but you do not pay this fee plus the cost of the ticket.
Procedures to follow:
- Print and complete the Infractions form.
- Sign the appropriate deferral agreement (obtained from the Prosecutor's
office)
If you are under 18 years of age, a parent or guardian, along with yourself, must sign this agreement. - Enclose a money order or a cashier’s check payable to the Perry County Clerk and mail it BEFORE YOUR COURT DATE with the completed form and deferral agreement to: The Perry County Prosecutor, 601 Main Street, Suite C, Tell City, IN 47586.
NOTE: If you fail to pay in person or mail the agreement and payment to us in a timely fashion you cannot participate in this program and must either appear in court or pay your fine and court costs as indicated on your ticket.

- Improper display of license plate
- Improper start from parked position
- Improper turn
- Improper land usage
- Improper passing
- Improper packing
- Left of center
- No or improper windshield wipers
- No or improper brake lights
- No or improper license plate light
- No or improper rear view mirror
- No or improper tail lights
- No or improper head lights
- No or improper brakes
- No or improper mufflers
- No or improper bumper
- Passing on double yellow line
- Seat belt violation
- U-turn
- Wrong way on one way
